4.1 Product Descriptions

However, we do not warrant that product descriptions or other content on the Site are accurate, complete, reliable, or error-free. Colors and appearances may vary depending on your device's display settings. If a product you receive is materially different from its description, please contact us in accordance with our Returns & Refund Policy.

 

4.2 Pricing

All prices displayed on the Site are in U.S. dollars unless otherwise stated. Prices are subject to change without notice. We reserve the right to correct pricing errors at any time. If we discover a pricing error after you have placed an order, we will contact you to inform you of the correct price and give you the option to proceed at the corrected price or cancel your order for a full refund.

Prices do not include applicable taxes, customs duties, or shipping fees, which will be calculated and displayed at checkout.

 

4.3 Product Availability

All products are subject to availability. We reserve the right to discontinue any product at any time. If an item you ordered becomes unavailable after your order is placed, we will notify you and offer a full refund or an alternative product of equal value, at your choice.

 

Placing an order on our Site constitutes an offer to purchase the selected products at the stated price. Your order is not accepted, and no binding contract is formed, until we send you an order confirmation email. We reserve the right to refuse or cancel any order at our discretion, including in the following circumstances:

•       The product is unavailable or out of stock

•       We are unable to verify payment or billing information

•       The order appears to be fraudulent or placed in violation of these Terms

•       A pricing error has occurred on the product page

•       Your shipping address falls outside our delivery coverage area

If we cancel your order after payment has been processed, you will receive a full refund within 5–10 business days. Order cancellations by the customer are subject to our Cancellation Policy in the Returns & Refund Policy.

 

6.1 Accepted Payment Methods

We accept the following payment methods: Visa, Mastercard, American Express, Discover, PayPal, Apple Pay, Google Pay, and store credit. All payment information is encrypted and processed securely by our PCI-DSS compliant payment partners. We do not store your full credit or debit card number on our servers.

 

6.2 Authorization and Charges

By submitting your payment information, you authorize GlamDesignerGlasses.com to charge the total order amount, including applicable taxes, duties, and shipping fees, to your selected payment method. You represent and warrant that you are authorized to use the payment method provided.

 

6.3 Fraud Prevention

To protect our customers, we use automated fraud detection systems. Orders flagged for review may require additional verification before processing. If your order is held for fraud review, we will contact you by email. GlamDesignerGlasses.com reserves the right to cancel any order it believes to be fraudulent, and to report suspected fraud to the relevant authorities.

 

6.4 Chargebacks

If you initiate a chargeback or payment dispute with your bank or card issuer without first contacting us to resolve the issue, we reserve the right to suspend your account and dispute the chargeback. Please contact us at info@glamdesignerglasses.com before filing a chargeback so we can work to resolve the matter promptly.

 

Sales tax will be collected on orders shipped to states where GlamDesignerGlasses.com has nexus, as required by applicable law. The applicable tax rate will be calculated and displayed at checkout based on your shipping address.

For international orders, import duties, customs fees, and value-added taxes (VAT) may be assessed by the destination country's customs authority. These charges are entirely the customer's responsibility and are not included in the product price or shipping fee. GlamDesignerGlasses.com is not liable for delays caused by customs processing.

 

8.1 Our Content

All content on the Site — including but not limited to text, images, photographs, graphics, logos, icons, audio clips, data compilations, software, and the overall design and appearance of the Site — is the property of GlamDesignerGlasses.com or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

You agree to indemnify, defend, and hold harmless GlamDesignerGlasses.com, its officers, directors, employees, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:

•       Any User Content you submit

•       Your violation of any third-party right, including intellectual property rights

•       Your violation of any applicable law or regulation

We reserve the right to assume control of the defense of any matter subject to indemnification by you, in which case you agree to cooperate with our defense of such matter.

 

These Terms shall be governed by and construed in accordance with the laws of the State of Pennsylvania, United States, without regard to its conflict of law principles. Subject to the arbitration agreement in Section 16, any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Doylestown, Pennsylvania, and you hereby consent to the personal jurisdiction of such courts.

For consumers in the European Union or United Kingdom, nothing in these Terms affects your rights under mandatory local consumer protection laws.

 

16.1 Informal Resolution

Before initiating any formal legal proceedings, you agree to first contact us at info@glamdesignerglasses.com to attempt to resolve the dispute informally. We will try in good faith to resolve the dispute within 30 days of receipt of your notice.

 

16.2 Binding Arbitration

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site (excluding claims for injunctive or other equitable relief) shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court.

The arbitration will be conducted in Doylestown, PA, or remotely if mutually agreed. The arbitrator's decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction.

 

16.3 Class Action Waiver

YOU AND GLAMDESIGNERGLASSES.COM AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of a class or representative proceeding.

 

16.4 Exceptions

Either party may bring an individual action in small claims court for disputes that qualify. Either party may also seek emergency injunctive relief from a court of competent jurisdiction to preserve the status quo pending arbitration.

 

If the class action waiver in Section 16.3 is found to be unenforceable in any proceeding, the entire arbitration agreement in this section shall be null and void, and the dispute shall be resolved in a court of competent jurisdiction.

 

GlamDesignerGlasses.com shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, civil unrest, acts of terrorism, government action, labor disputes, power outages, internet or telecommunications failures, or actions of third-party service providers such as shipping carriers.

In the event of a force majeure event, we will notify affected customers as soon as reasonably possible and will make reasonable efforts to fulfill outstanding orders as circumstances permit.

 

These Terms, together with our Privacy Policy, Shipping Policy, and Returns & Refund Policy, constitute the entire agreement between you and GlamDesignerGlasses.com with respect to your use of the Site and supersede all prior agreements, representations, and understandings.

If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed from these Terms if modification is not possible, without affecting the validity or enforceability of the remaining provisions.

Our failure to enforce any provision of these Terms shall not be construed as a waiver of our right to enforce that provision in the future.
